TERMS AND CONDITIONS
TocArt School

Completion of registration and payment of the initial registration fee along with the first installment imply the student's express acceptance of these Terms and Conditions.

1. SCOPE OF APPLICATION

These Terms and Conditions govern the relationship between Tocart School and its students, establishing the rules for participation in training activities, access to and use of the facilities, and the general administrative operations of the School. For any questions or clarifications, you can contact the School at tocartpercusion@tocartpercusion.com or via WhatsApp message at +34 601 503.

2. REGISTRATION

The initial registration fee is a mandatory one-time payment due upon registration. This amount is non-refundable under any circumstances.

3. CLASS RESERVATIONS

  • All classes require prior reservation through the BSport app.

  • Reservations can be made up to the start of the session and up to 30 days in advance.

  • Reservations guarantee a place in the session and are an essential requirement for access to the classroom.

  • The School will offer classes throughout the year, including the summer months (July and August), although the class schedule during these months may be adapted and differ from the schedule established for the rest of the academic year.

4. ATTENDANCE, CANCELLATIONS, AND MAKE-UP POLICY

Cancellations by the student: If the student is unable to attend a class previously reserved through BSport, the student is required to cancel their reservation to free up their spot.

Active classes: Scheduled classes will not be canceled if at least one student is registered.

Teacher substitution: In the absence of a regular teacher, the School will appoint a substitute teacher.

Making up classes: Absences do not entitle the student to make up classes or receive a refund. The only exception to this rule is the cancellation of the class by the School due to force majeure.

5. FEES, BONUSES, AND PAYMENT METHODS

  • Payment Method: The only accepted payment method is debit or credit card through the BSport platform.

  • Monthly Fee: A fixed monthly amount is established, which does not vary based on holidays or the number of classes taught in the month. Payment is made on the 5th of each month. If registration is made after this date, the first monthly payment will be prorated.

  • Quarterly Plan: The quarterly plan entails a fixed amount, regardless of holidays or the number of classes, and is charged at the time of purchase and every three months on the same date.

  • Bounties: The vouchers have a limited validity period limited to their specific period. To ensure continuity of the School's services, these vouchers must be renewed no later than one month after their expiration date. If the student does not formalize the subsequent subscription within this period to ensure their continued enrollment at the School, they will automatically lose access to the WhatsApp group and associated audiovisual materials.

  • One-time or trial classes: These classes require a one-time payment and are non-refundable.

  • Maintenance fee (optional): This non-refundable fee is designed for students who need to pause their attendance for a period without formalizing a withdrawal. The maintenance fee secures the reservation of their spot and exempts the student from paying tuition once they resume their regular enrollment.

6. PAUSES, WITHDRAWALS, AND WITHDRAWAL

  • Temporary withdrawal: The student must notify the student in writing (via email or WhatsApp) at least 15 days before the next fee payment date. This option allows the student to exchange the previous fee for the "maintenance fee."

  • Permanent cancellation: Notice of permanent cancellation must be given in writing at least 15 days before the next payment due date.

  • Failure to comply with the notice period: Failure to comply with the established notice periods will result in the next monthly payment being charged, with no refund available.

7. MANAGEMENT FEES

  • Late Changes or Withdrawals: Processing a fee change or withdrawal that does not meet the established deadlines will incur a 4% surcharge plus a fixed fee of €3.

  • Exceptional Refunds: Refunds will only be issued in duly justified exceptional circumstances. In these cases, the aforementioned management fees will apply.

  • Non-Payments: The School will make up to five automatic collection attempts. If the non-payment persists, access to classes will be suspended. In the event of repeated non-payment, an additional €5 surcharge will be applied as a management fee.

8. MODIFICATIONS TO THE ACADEMIC PROGRAM

The School reserves the right to make adjustments to the content, schedules, dates, levels, or faculty assignments. These modifications will be made to ensure the quality of the training. Any changes will be communicated to students via email notifications through the internal reservation system.

9. USE OF MATERIALS AND FACILITIES

  • Teaching materials and equipment: The materials provided by the School are for collective use. The student is responsible for the care and proper use of said materials. Any damage caused by misuse will be charged to the responsible student, who will be responsible for the cost of repair or replacement.

  • Access and handling restrictions: Relocation of materials and access to practice rooms without faculty supervision is prohibited.

10. CODE OF CONDUCT AND COEXISTENCE

  • An environment of mutual respect and tolerance is promoted among all members of the educational community.

  • Offensive, discriminatory, homophobic, sexist, or racist behavior is strictly prohibited.

  • Failure to comply with these rules of coexistence may result in disciplinary measures, including expulsion without the right to a refund of any fees paid.

11. PERSONAL DATA PROTECTION

The personal data provided by students will be processed in accordance with the General Data Protection Regulation (GDPR) and current Spanish legislation. For detailed information on the processing of your data, please consult the School's Privacy Policy.

12. RESPONSIBILITIES AND EXEMPTIONS

  • Students participate in all training activities at their own risk. The School assumes no liability for personal injury or property damage that may arise from the activity.

  • Furthermore, the School is not responsible for the loss or theft of personal belongings within its facilities.

Confirmation of registration and payment constitute a declaration that you have read, understood, and accepted all of these Terms and Conditions.
